EFEKTIVITAS PELAKSANAAN PERATURAN GUBERNUR BALI NO. 10 TAHUN 2021 DI DESA ANTIGA

Abstract

Penelitian ini bertujuan untuk mengetahui efektivitas Peraturan Gubernur Bali Nomor 10 Tahun 2021 tentang Penerapan Disiplin dan Penegakan Hukum Protokol Kesehatan Sebagai Upaya Pencegahan dan Pengendalian Corona Virus Disease 2019 Dalam Tatanan Kehidupan Era Baru di Desa Antiga yang ditinjau dari teori efektivitas hukum serta untuk mengetahui upaya dari Pemerintah Desa Antiga dalam mendisiplinkan masyarakat dan menegakan hukum protokol kesehatan. Metode Penelitian dalam tulisan ini menggunakan penelitian hukum empiris dengan mewawancarai pihak Pemerintah Desa Antiga. Hasil penelitian memperlihatkan bahwa Peraturan Gubernur Bali Nomor 10 tahun 2021 di Desa Antiga telah berlaku secara efektif dengan terpenuhinya faktor-faktor efektivitas hukum, namun efektivitas tersebut masih perlu ditingktakan terutama pada faktor kesadaran masyarakat. Kemudian terkait pelaksanaan disiplin dan penegakan hukumnya, Pemerintah Desa Antiga mengambil upaya penanganan dengan penguatan 3T (Tracing, Testing, Treatment) sejak dua orang warga terkonfirmasi positif, serta melakukan upaya preventif seperti sosialisasi, penertiban melalui razia masker, pembatasan kegiatan keagamaan. Sedangkan untuk penegakan hukumnya Pemerintah Desa Antiga memilih memberikan penindakan secara humanis dan persuasif, daripada sanksi administratrif sebagaimana diatur dalam Peraturan Gubernur Bali Nomor 10 Tahun 2021, namun dikecualikan jika pelanggaran dilakukan berkali-kali.

This study aims to determine the effectiveness of the Bali Governor's Regulation Number 10 of 2021 concerning the Application of Discipline and Law Enforcement of Health Protocols as an Effort for Prevention and Control of Corona Virus Disease 2019 in the New Era of Life in Antiga Village in terms of the theory of legal effectiveness and to find out the efforts of the Government Antiga Village in disciplining the community and enforcing health protocol laws. The research method in this paper uses empirical legal research by interviewing the Antiga Village Government. The results of the study show that the Bali Governor's Regulation Number 10 of 2021 in Antiga Village has been effectively implemented with the fulfillment of legal effectiveness factors, but the effectiveness still needs to be improved, especially on the public awareness factor. Then related to the implementation of discipline and law enforcement, the Antiga Village Government took handling efforts by strengthening 3T (Tracing, Testing, Treatment) since two residents were confirmed positive, as well as carrying out preventive efforts such as socialization, control through mask raids, restrictions on religious activities. Meanwhile, for law enforcement, the Antiga Village Government chooses to provide humane and persuasive action, rather than administrative sanctions as stipulated in Bali Governor Regulation Number 10 of 2021, but is excluded if violations are committed repeatedly.
