This study aims to analyze the legal regulation concerning the use of Balinese customary facilities in political campaign activities and to examine the constitutional perspective on the prohibition of political campaigns within customary facilities in relation to the protection of political rights and the recognition of customary law communities. This research employs normatif legal research methods using statute approach, conceptual approach, and analytical approach. The collection of legal materials was conducted through document studies on primary, secondary, and tertiary legal materials, which were analyzed qualitatively. The findings reveal that Law Number 7 of 2017 concerning General Elections does not explicitly regulate the prohibition on the use of customary facilities as political campaign venues, resulting in normatif ambiguity and legal uncertainty. In fact, customary facilities in Bali possess communal, religius, and cultural characteristics that distinguish them from ordinary public facilities and constitute part of the constitutional identity of customary law communities recognized under Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia. From a constitutional perspective, the prohibition of political campaigns in customary facilities has legitimate legal justification because it aims to protect customary law communities, maintain public order, and prevent social conflict within a democratic society. Therefore, reformulation of electoral law policy is necessary to explicitly regulate the prohibition of the use of customary facilities for political campaigns in order to promote substantive democracy and the protection of customary law communities in Indonesia.
